Thank you very much. Let's put that to a vote. All in favor raise your hand or say I. I see no one opposed. That is carried. Are there any requests for withdrawal or adjournment? >> No, Mr. Chair. >> Thank you. Have the committee members had the opportunity to review the minutes from May 19th, 2026? Are there any questions or comments about the minutes? Okay, can I request a mover and a seconder to approve those minutes? Okay. I see Dylan and Adam. Dylan is going to move and Adam is going to second that. And we'll put that to a vote. All in favor raise your hand or say I. I see no one opposed. That is carried. All right. Tonight we have one application before us. And the the first application is A0626 for 10 Mountain Street. And I'll turn it over to Delhera for the to present the application via PowerPoint. >> Thank you, Mr. Chair. So, the purpose of this application is to facilitate the construction of a covered landing and barrier-free access ramp. The variance requested is to permit a maximum rear yard encroachment of 6 and 1/2 m, whereas a maximum rear yard encroachment of 1 and 1/2 m is permitted. This is an image of the site plan, which was circulated along with the notice of hearing. This is an image of the neighborhood for context. These are the current conditions on site. These are images of uh what is proposed provided by the applicant. And these are the agencies that have provided comments, and I will summarize those comments for you now. Planning staff recommend that minor variance application A 0626 for 10 Mountain Street be approved as the requested variances are considered to be minor in nature, appropriate for the development or use of the land building or structure, and are considered to maintain the general intent and purpose of the bylaw and the official plan pursuant [clears throat] to subsection 45 1 of the Planning Act. They also recommend the following condition. The proponent is to ensure that the lots of 10 Mountain Street and 12 Mountain Street are merged prior to the approval of a building permit and or site plan approval that depicts work occurring across property boundaries of the parcels, which can be identified pins of 46022 -0065 and 46022-0066 [clears throat] respectively. Heritage planning staff are supportive of the requested minor variance as the alterations on the site do not result in any adverse impacts to the identified cultural heritage. Further, these required alterations support the long-term retention of the building. Development engineering services has no objection to the requested variance from an engineering perspective. However, the proposed works associated with the minor variance represent a significant modification to the site and will require site plan approval. They recommend the following condition. The owner shall obtain site plan approval from the town of Grimsby if the subject lands are to be modified to construct additional parking spaces, change the parking lot and entrance, and or a combination of works that will materially alter the existing lot grading and drainage. Um furthermore, as the subject property fronts onto a regional road, the town will request that the region of Niagara review the proposal for the purpose of securing any required road widening dedication through the site plan approval process. >> [snorts] >> The NPCA had the following comment. There are no NPCA regulated features on or within proximity of this address. We offer no objections of development. >> [snorts] >> The Niagara region and Grimsby Power had no comments. Back to you, Mr. Chair. >> Thank you. I'll now call on the agent or the owner to speak to the application and the reasons for the minor variance. Is there a representative here? You? If you wouldn't mind just coming up to the microphone just at the end of our Yeah, that should work. Is that one fine? You know what? Come come to this one here just towards the end of us. Yeah. Yeah, perfect. Thank you so much. And if you could just state your name and address for the record, that would be great. >> Yeah, um my name is Rochelle Blocker and my address is 272 Central Avenue here in Grimsby. >> Okay, perfect. If you could just speak to the reasons as to why the minor variance is needed. >> Sure. >> Thank you. >> Good evening, Mr. Chair and members of the committee. I am appearing this evening on behalf of the Living Light Canadian Reformed Church in support of the minor variance application A06-26 for our property at 10 Mountain Street. The purpose of the application is to permit the construction of a covered landing and barrier-free accessibility ramp as was reviewed by staff this evening. I won't go through the details of it again. Um This work is part of an overall project which is a renovation to the existing basement and improvements to the main floor that will be doing to allow for improved flow and function for our historical character and the historical use of the building as a place of worship. Um and the estimated project budget of all of the work that will be doing lands around $2 million. And this does not include the work that's already been done to the building and property up to this point. Um addition of air conditioning units, replacing the existing roof shingles, landscaping around the property, probably projects that you've noticed um over the last year or so. Um the proposal is intended to improve the accessibility to the building for people of all ages and abilities. And it forms part of a broader effort to make the facility just more inclusive and functional for our membership as well as outward to the community. Um as was presented, planning staff have have concluded in their report that the variance satisfies all four tests under section 45 of the Planning Act, so I won't go back into that again. Um But beyond satisfying a technical planning requirement for us, this project reflects an important part of our church being able to fulfill our desire as a congregation to be faithful in our worship primarily in this building. Um to be healthy in our relationships as we use this building and intentional uh intentional about how we serve our community. The addition of the barrier-free access ramp will provide improved accessibility to all members of our community to access our worship services and special events that we put on throughout the week, which include Bible study groups, um Bible study classes. We started a warm lunch Wednesdays program uh last fall and that continued through the winter and spring, which was well received by the community where um community members were invited to come and have some lunch and enjoy some music that were that was put on by uh some of the members of our congregation. So, we'd like to continue to offer programs and services like that. Um and with the renovation, our building will be that much more suited to do more things. Um so, according to all of that, we respectfully request that the committee approve the application subject to the updated conditions that were given tonight um and as was previously outlined in the staff report. So, thank you, Mr. Chair and members of the committee that are present here tonight for your time in reviewing our application and we would be pleased to answer any questions that you might have. >> Thank you. Uh and to that point, are there any questions from the committee? Yeah, go ahead. >> Um have you reviewed the conditions that they're proposing to attach? Do you have any objections to them at all? Like one was about the merging of the parcels. It wasn't spoke to yet or you didn't mention it all in your presentation. I know that's an issue. >> Yeah, so um I don't I I know whether it was mentioned in the report off-hand or not, but we did provide proof that the um properties are merged on title. Um they're merged under one PIN, so I've been told by planning staff that that condition is already satisfied. Maybe Manny can confirm that. >> Yeah, Adam, you have your hand up. Go ahead. >> Yeah, thank you Mr. Chair. It's for you uh to planning. Um just wondering if they could just explain the rationale of um the second condition just in terms of is it prevent mention of the parking lot into the rear rear yard approach? >> Um so I guess the second question first. Uh Yeah, the basically as a part of the the overall works um there were some work that was uh kind of depicted on the plans for some parking lot uh modifications. Uh those aren't necessarily directly related to the the variance. Um but those works would require some sort of review from our engineering staff uh through like a site plan approval uh process either type three or greater. Um so it's basically just to cover that part and that any sort of work or integrating that kind of thing would be would have to go through a different process or a review. >> Okay, thank you. >> So it's yeah, it's not we we kind of specified the condition afterwards uh um from talking to the proponent uh to kind of focus or make sure that the condition is more focused uh to what it really is and that the variance is kind of like a for the porch which is what it is is like a separate separate uh >> Okay, make [clears throat] it. >> Yeah. >> Okay, thank you. Uh over to Kevin. >> Yeah, uh through you, Mr. Chair. So, just for clarification, the site plan isn't being triggered by this particular variance and the request to put on the barrier-free access ramp. It's only if I I read if in here if they want to go and and change the parking layout or a new driveway things like that. So, they're kind of two separate things. You're just covering yourself to say if they go further than what's proposed here, then that would trigger site plan. Cuz I have no problem with that. I I just don't want to trigger site plan over a barrier-free entrance ramp. >> Yeah, exactly. Yeah, exactly. Yeah, if if there's modifications that are going to have to be done in the future for the parking lot, uh more spaces added, more paving, that that's when well, that that'll kick in. But, this this this will not trigger that. This approval [snorts] of the of the variance. >> Okay, thank you. Any other questions from the committee? Yeah, go ahead, Dylan. >> Uh yeah, through you, Mr. Chair. Just further to Kevin's um question for Mr. Singh is have the properties is there like the confirmation that you received from the applicant is is is valid and the and they have been um merged? >> Um yeah, so the applicant provided uh a deed or instrument from uh I guess the land registry office indicating that there is ownership of the of the lands. If there's an an more if there's another administrative stuff that needs to be taken, uh that was more that was to cover that. Uh but, from our perspective, it it looks like they are owned by same owner. >> Thank you. Uh anything else from the committee? Is there anybody in the public? I don't see anyone online, but maybe they're not showing. Anybody else would like to speak or ask questions about this application? I see none. Do we have a resolution we can read? Yeah. Yeah, thank you. Go ahead. >> [gasps] >> Okay. So, having heard the verbal evidence and written reports from staff, resolve that minor variance application A0626 from 10 Mountain Street to permit a maximum rear yard encroachment of 6.5 m, whereas a maximum rear rear yard encroachment of 1.5 m is permitted according to section 4.9C in zoning bylaw 45 or 1445 as amended be approved with the conditions as proposed or written here that proponent ensure that the mountain or the lots of 10 and 12 Mountain Street are merged prior to the approval of the building permit and/or site plan approval that depict depicts work occurring across property boundaries of the parcels on the pins 0065 and 0066, respectively. And two, that the owner shall obtain site plan approval from the town of Grimsby if the subject lands are to be modified to construct additional parking spaces, change the parking lot alter the existing lot grading and drainage. Um being that it's in conformity with the official plan zoning bylaw is minor in nature and is appropriate for the development use of the property. So moved. >> Okay, thank you. Do I have a second on that? FA, thank you. And let's put this to a vote. All in favor, raise your hand or say I. I see no one opposed, so that is carried. Please note that there is a 20-day appeal period uh from today um the decision. Thank you very much. Uh that's it. We had one application. So, the next meeting for Committee of Adjustment will be held on July 21st, 2026, and this meeting is adjourned. Thank you. >> Recording stopped.
