So, anybody everybody's clear on that? Okay. Last thing I'll say is there's going to be we're going to have staff come up and speak and although they have done it a few times, uh we're also going to have residents come up and speak. Those residents may not have spoken in public before, may not be comfortable. So, at this time, I'd like you to take out your phones and put them on inaudible um communication. Turn the ringer off. If it goes off during the council uh during the any presentations, you're going to get a dirty look from me. But if it goes off again, I'm going to ask you to leave. Okay? So everybody just be very respectful of anybody that's coming forward to ask any questions. U we'll get through this meeting together. And with that I will ask Andrea to come on up and uh provide the presentation. >> Good evening chair and vice chair members of committee members of the public and city staff. My name is Andrea Zen and I am the planner assigned to process and review the subject application. The purpose of this public meeting is to provide information to the public and seek feedback on the application filed by GSAI on behalf of the owner. Next slide, please. The subject property is located in W 6 at 8799 Heritage Road in the southwest part of Bmpton. The nearest major intersection is Heritage Road and the Lion Head Golf Club Road. Next slide, please. The slide shows an overview of the site. Surrounding land uses include to the north is low-rise residential dwellings. To the south is single detached dwellings beyond which are lands containing natural heritage features. To the east is low-rise residential dwellings and public park. To the west is heritage road beyond which our agricultural lands and lands continue natural heritage features. Next slide please. This slide shows a further overview of the subject site and the surrounding uses and developments. Next slide please. A site visit was conducted on March 24th, 2026. Photos from the visits are shown on screen. Next slide, please. The applicant has submitted an application to amend the official plan zoning bylaw and for draft plan of subdivision in order to facilitate the development of a 10story residential apartment with a commercial uses on ground floor and three blocks of stacked town houses. The application is proposing a total of 162 residential apartment units and 48 stacked town houses units. A total of 35 parking spaces are proposed, including spaces for residential use, visitors, commercial use, and accessible spaces. The proposal also includes a commercial area of 225 square meters on ground floor of the proposed 10-story apartment building. Vehicular access point is proposed from the heritage road and connecting through to Fordham Road. Next slide please. Prior to finalizing recommendations to council, this application will be further evaluated for consistency with the planning act, provincial planning statement, conformity with the 2006 city of Bmpton official plan, the new Bmpton plan, and the Bram West secondary plan. Next slide, please. The subject land is designated residential and open space in the city of Bmpton official plan 2006. The residential designation permits a wide range of residential land uses including single detached semi- detached stacked town homes and high-rise apartments. The open space designation allows for public and private open space, valleylands, water course corridors, wetlands, and woodlands. To facilitate this development and requested uses, an amendment to the official plan is not required. Next slide, please. In the new BMPON plan, the subject site is designated community areas and natural heritage system on schedule 1A and neighborhoods and natural heritage system on schedule 2. Next slide, please. The subject lands are located within the Bram West secondary plan area 40D. They are designated as low medium density residential and well land. Low medium density residential designation permits a broad range and mix of lot sizes for single detached, semi- detached and townhouse units in accordance with relevant city guidelines. Well land designation primarily permits the preservation and conservation of the natural features, functions and linkages. 10-story apartment building shall not be permitted on lands designated lowmedium density residential. An amendment to the secondary plan is required to facilitate the proposed development. Next slide, please. The proposed official plan amendment will redesate the subject site in Bram West Sanctuary Plan from low medium density residential and valley land to mixed use with a special policy area and valley land. Next slide please. The subject lands are zoned agriculture zone. Permitted uses in the agriculture zone include but are not limited to agricultural purposes, non-aggricultural purposes including single detached dwelling, supportive housing residential type one or type two and purposes accessory to the other permitted purposes. A zoning bylaw amendment is required to permit the uses. Next slide please. As such, the applicant is proposing to amend the zoning bylaw by reszoning the subject site from the current agriculture zone to residential apartment and multiple town home R4A zone with special section and a residential townhouse R3C zone with special section and open space zone. The newly created residential apartment zone with a special section will permit the uses of apartment building, various types of town houses, dwellings, retirement community and accessory uses. Permitted uses in the residential townhouse zone with a special section will include the townhouse dwellings supportive housing resident type one place of worship and accessory uses permitted uses in the open space zone include conservation uses and recreational facility. Next slide please. At this time, key issues and considerations that will need to be addressed include building height transition and setbacks, including transition to existing low density residential neighborhood and ensuring appropriate height transition and building setbacks are implemented through the zoning bylaw amendment process. Traffic increase in density and traffic implications on Heritage Road and Fortam Road. Other issues matters such as servicing capacity including water, sewer, storm water are to be deemed suitable for the development. Protection of the natural heritage system features and ensuring appropriate size of proposed amenity spaces are provided. Next slide please. The application filed with the city and deemed complete on April 16th, 2026. The application was circulated to commenting departments and agencies. Once again, my name is Andrea Xan and my contact information is posted on the screen along with the contact information of the applicant Ethan Bonard from GSAI who is representing the land owner. For any questions or comments about this development application, please feel free to contact myself, my manager or the applicant. This concludes my presentation. Thank you, Conley, and have a great evening. >> Thank you very much, Andrea. Um okay we have two delegations for this item and they've asked to go in reverse order. So uh Gerpreatit Sambi is first group come on down and Rash Raj Shaw be ready for um the next one. >> Am I here? >> Yep. Right there. Excellent. >> Welcome. You have five minutes. Okay. Excellent. Uh thank you city uh council. Uh my name is Gerrit Sambi. Uh I live at 80 Work Green Parkway and I'm here to uh present our community objection to the proposed 10-story apartment tower at 8799 Heritage Road. I would like uh next slide, please. Uh these are our uh grounds for objection. However, I would like to set the table with two important points that I'd like to start with. Uh first one being that uh myself uh and the um individuals uh who have purchased homes in this neighborhood had the expectation that we would be uh purchasing homes with uh development of 17 detached homes to be uh created on this site. However, to pivot from 17 detached homes to a 10-story tower is not an incremental evolution. It is a wholesale abandonment of the vision that was presented to the people who lived here now. And the second point I would like to point out is uh bill 23 specifically that that legislation. It has created in practice significant pressure on municipalities to uh to approve highdensity development at a pace that outstrips the capacity of local infrastructure services and communities to absorb it. We are opposed to the exploitation of a legislative instrument designed to build homes faster being used to justify the imposition of a 10-story tower on a low-rise neighborhood that is entirely unprepared. The city of Bmpton must not sacrifice the well-being of exist existing residents on the alter of density targets driven by provincial legislation. Next slide please. Uh this slide goes over the uh timeline of the uh planning history for this particular project uh starting with 0.1 in 2016. A preconultation submitted for 17 detached homes which was fully compatible with the existing neighborhood character. Fast forward to 2019, property was listed on Bmpton's municipal register as a heritage resource. It was in the works to obtain that status. Following the CO 19 pandemic, the city had removed that heritage designation and concluded that the property no longer met the threshold of a heritage criteria. And here we are today for an application of a 10-story 162 unit apartment tower being submitted. Community was not born. Community was not consulted. I would ask that everyone consider how would a listed heritage property become a 10-story tower in just 7 years without any warning or consultation. It does beg the question. Next slide please. Next. Uh the flawed transportation impact study. Uh if you look on the left hand side of the screen, there are several streets that were not considered uh and entirely omitted from the study that were under development and have now been fully developed. H taking that into consideration including that the data itself is outdated stemming from an August 2024 study um it uh does uh uh point to the fact that we there needs to be updated information. The Shiri Bhagavad Gita Park was entirely ignored from this study as well which is a center point for this community with high vehicular traffic uh and and for child safety. No school traffic provision f for future Peele District School Board and Duffren Peele County Catholic School Board development was accounted for. No uh uh no Ford Hem Road notice was ever posted. Um the sign is only placed on Heritage Road with low foot traffic. Um and does suggest a disingenuous uh uh movement from the developer to uh sh to reduce the uh attention on this particular project. Next slide, please. Traffic crisis and pedestrian safety. Uh, you know, Heritage Road is chronically congested. We have an Amazon facility at Heritage and Steels which uh drives significant commercial and vehicular traffic on a daily basis. There's already been a documented pedestrian fatality on this particular road. Uh, more troubling I would s I would point out to is the fact that there is an entryway proposed on Fordham Road and Xworth Circle. both both streets with low density detached homes that were never designed to take on high density vehicular traffic and with this proposal would pose a significant um a significant risk to uh all the residents that are in that particular community. Next slide please. Again uh bill shedding light on bill 23 and the concerns that we have with uh how that is being utilized. Next slide please. what the residents of this community expected. We expected 17 detached homes in that 2016 study. Um, we expected growth that was compatible with the roads and infrastructure for this community. Next slide, please. Next slide, please. Our formal demands of the city of Bmpton include refusing the 10-story apartment outright and without reservation. We we would request a full transparent accounting of the decision to remove heritage designation from this property and reject the transportation impact study as inadequate. >> Thank you. >> Okay. And I I I realize you rushed through it. Staff have your presentation. Okay. >> You have also submitted correspondence. We have. Yes. >> Okay. So, just just for your um awareness that it doesn't you rush through everything. we're gonna take everything and look at it and address the concerns. Now, some of the concerns though may not be on the heritage uh aspect of it. And it sounds like something was listed or what's the first phase of the of heritage listed before it designated and before it went to designation, it was removed, which is often what what happens. We we look at a site to say, "Oh, that looks heritage." That's right. And then we do the deeper dive. Oh, it's actually not. So, sometimes that happens. Okay. Not talking specifically with this application, just across. You did mention about uh notice. This is that time. This is the time where we're asking the residents to come forward um during the public meeting. Okay? So, I don't want you to think any work has really been done up until now when the sign's been posted, the letters have gone out, and this is for anybody that's coming for a public meeting. This is your time to have your voices heard. Okay, >> I appreciate that. Thank you. >> Thank you very much for your delegation. And next up is uh Rash Rash Shaw. >> Welcome sir. You have 5 minutes. >> Thank you. Uh good evening and thank you for the opportunity to speak. Uh I'm here to supplement the presentation already made on behalf of our community by Gurit uh regarding the proposed development at 8799 Heritage Road, including the 10-story 162 unit apartment tower that forms the core object core of the objection before council tonight. Although two of us are speaking this evening, we are speaking with one voice. We are here representing a community that is overwhelmingly aligned in its opposition reflected in the 225 signatures and more than 340 online signatures. Even that that the wet signature total understates the true level of concern because the petition had to be finalized for submission before additional residents who wanted to sign could be included. The response came from across the community and across age groups from younger families, longtime home owners, park users and residents at a different stages of life. What I want council to understand is this. This opposition is real. It is organized and it is deeply felt. These signatures were not collected casually. They were gathered through door-to-door outreach, repeated conversations, follow-ups with neighbors, and direct engagement with residents who took the time to understand what is being proposed and to say clearly that this tower does not belong here. And what stood out most was the consistency again and again. Residents raised the same concerns. the scale of the tower, the impact to the safety, the traffic it will add, the strain on the local infrastructure, the impact of the surrounding neighborhood, and the growing pressure on the nearby park and public spaces. A community video was also recorded to reflect those lived concerns from people using the and experience the area firsthand, including park visitors. However, because it because children could not be included as part of the public submission, that video was not not filed. But the concerns reflected in it remain very well very wide uh very widespread and very important. This is not a small pocket of resistance. This is not a reaction for the sake of reaction. This is a serious informed and unified response from the people who live here walk these streets use this park and will carry the consequences of the this decision long after the meeting is over. Council is not being asked to guess how the community fails. The community has made its position unmistakably clear. Please treat this petition for what it is, not just a collection of names, but a clear and a unified warning from the community that this tower is incompet incompatible with the area and should not be able to proceed in its current form. That's it. Thank you. >> Thank you very much for your delegation. Have you submitted the names and >> uh yeah, the the I've complet uh submitted the soft copy or scanned of all the signatures. >> Okay. But I do have the hard copy here just in case. >> Okay. Do we want to take the hard copy? >> We're good. We have the soft copy. Yeah. Perfect. >> With all the >> Okay. Thank you very much for your delegation. >> So now I'll open it up to the floor. If there's anybody else that would like to come and delegate on this item, they can come down and do so. Now I'll ask again if there's anybody in the audience that'd like to come ask a question or uh provide any comments on this application. more than welcome to come now. Seeing none, it's been move uh received by councelor BR um the statutory public meeting. All in favor that carries and members will be notified uh of the public when that staff report is written and when it's coming back and we'll receive the delegations and the massive number of correspondents. I think that's the most correspondence I've seen in a long time. Next item is item 7.2 is the file oz202400623407 Countryside Drive. There was a delegation for that item. It is. Oh, there's a number of delegations. Uh, we have Bruno Spina. Am I on the right number? Bruno Spina, son of the late great Joe Spina. >> Yeah, thank you very much. Uh, good evening everybody. Uh, my name is Bruno Spina. I live at 30 Adriatic Crescent um which is basically adjacent from this building that they're proposing to be built. Um this area historically has been characterized as by an estate homes low density housing and a quiet residential neighborhood. Uh the introduction of this high-rise development is fundamentally incompatible with the existing character and community and it raises several significant concerns. First is the current road infrastructure is already operating at or near maximum capacity. The uh main road consists of four lanes experiencing consistent congestions during peak hours. The addition of a large number of residential units will inevitably increase the traffic flow in volume beyond what the existing infrastructure can safely and efficiently accommodate. uh there has been no clear and adequate plan presented to address this uh feasible strain on the environment. Um secondly, the proposed development will contribute to increased noise pollution both during construction and after occupancy. Um a shift from a low density neighborhood to a highdensity residential environment will alter the peaceful nature of the area and negatively impact the quality of life of the current residents. Thirdly, the height and proximity of the proposed building raises serious privacy concerns. Uh, many of the existing homes will be directly overlooked, resulting in a loss of privacy in the backyard and living spaces. I know for myself, my house is directly in front of it. My children's bedrooms are directly in front. My master bedrooms uh adjacent to the roadway uh which would be visible at night. Um, finally, the the introduction of this high-rise building in a nstate style neighborhood represents a stark and inappropriate departure from the established zoning characteristics. Such a development risks setting a precedent for further incompatible construction uh ultimately eroding the identity integrity of the community. Uh and for these reasons I strongly urge the appropriate authorities um to reconsider or reject the proposal for this development. Uh developing sorry development should align with the existing infrastructure capacity and preserve the characteristics the safety and in and livability of the neighborhood. Thank you everybody. >> Thank you very much. Uh next item Ryan. Next delegation Ryan Kelloo. Ryan, come on down. You're together. >> Yeah, it's uh Sorry, it's >> core. >> No, it's Ryan and John. >> Oh, I do. Sorry, I have Ryan and John. And then Ishnan. Oh, has withdrawn. My apologies. Okay, take it away, gentlemen. You have five minutes. Um so basically John and I giving this presentation where uh we both live on Louain Drive and the um proposed development uh overlooks both our houses as well as Bruno's. Next slide please. So um next slide please. So this is the development. Um so there's a in this development uh the developer is is basically going against the official plan amendment uh and the res with the reszoning and it's a clear departure from um what's around the area. A jump from low density customuilt homes to a 12story ISO with 128 u residential units. it's not acceptable. So, we have an attached petition that goes with this with 700 signatures from the community members. Um, we uh there's a hard copy that's been given. It is a live document, so people are still signing it. We ask council to maintain the privacy of everybody on that document because there's uh phone numbers, addresses, and names. Next slide please. So this is the neighborhood compatibility matrix. Uh and you can see clearly just the departure from uh low density single family custom lots to one um lot that's looking to be done as a high density. So the it's going to change the predictable residential flow and the parking. um it's going to impact all our properties and uh basically the fair proportionate munipal tax is not fair to have a high density when we've all paid for these custom homes in that area. Uh next slide please. This further uh makes my point and in the interest of time I'm going to move forward. Next slide please. So the off um the the official plan, a legal document the residents relied upon when investing their in their customuilt homes. Um allowing for this is an incomp incompatible build form that destroys the residential character of the neighborhood. More importantly, approving uh the OPA sets a dangerous president uh with that one house uh being sold uh to many more coming. Sean, next slide, please. So, uh we're going to look at the three threat vectors or risk vectors to neighborhood viability. Right. So, um first of all is spatial and environmental integrity. Specific to this project is there's an unacceptable transition of scale on overlook. We'll get into that more details later on. There are severe microclimate and shadowing impacts. The second vector is structural and subterranean viability. That's basically the structure of the building and the ground. Specific to this project are hydrogeeological risks to the foundation and unmeasured baseline infrastructure strain. Last but not the least are civic and systemic function risk factors here. Specific here is un unmititigated traffic congestion and incompatible built for setting in an irreversible president as Ryan had mentioned. Next slide please. So unacceptable transition of scale to the right to the left is an example of an acceptable transition. You have a a high building, a medium-sized building, and a residential area. The project being proposed to the right is it basically has what's called a cliff effect, right? There's zero privacy as Bruno has mentioned and and and it's just it's just unsightly and it's not does not meet the the requirements for our neighborhood. Next slide, please. And then microclimate degradation and unmitigated shadowing. I mean, there's going to be a huge shadow caused by this building, right? So we um we request that uh formally request a comprehensive shadow study to quantify the exact hours of solar gain lost. So of solar light lost due to the um to the height of the building. Next slide please. And there's also going to be severe hydrogeeological risks to existing properties. We think there's going to be you know to fit all those parking it's going to be three levels down. There's going to be a lot of risk of there's risk to the water table which is which can potentially cause sink holes. There's going to be risk to foundation, adjacent buildings and inground pools. Next slide, please. >> 30 seconds remaining. >> And then finally, there's a sudden baseline infra infrastructure strain. Basically, we don't have enough infrastructure, hydro, water to support the additional units, digital residences. Next slide, please. Next slide, please. Yeah. So, there's traffic issues. Sorry, one more ahead, please. there's going to be traffic issues and in short 700 signatures uh for good reason and there's not enough time. So uh you can actually go through the actual presentation and we look forward to the mayor, deputy mayor and tour coming to block parties where we don't have a monstrous building throwing a a big shadow over it, >> especially a block party that you guys take. >> Did you say block party? >> Yeah, you invited this year. I didn't get an invite last year. >> Huh? >> This year you're invited. >> I'm I'm coming. >> Everybody's invited. >> Thank you very much for your delegation. Appreciate it. Staff may want to take your numbers and maybe hire you for future planning. >> We're available. >> Thank you very much. Um we will bring forward the report now and the report is item 7.2 application amend official plan and zoning bylaw. uh G Walker Dome Surrender Molly Shaenjet Dollywall. The purpose is to permit a 12-story residential building consisting of 128 residential units the with ground floor commercial and 175 parking spaces location at 3407 Countryside Drive W. I'll go to my speakers list councelor Tour. >> Thank you three Mr. Chair. Uh thank you John Ryan Bruno. Uh, and I know all your neighbors that are watching online. Uh, I know the size of your neighborhood and how collective you are and I'm sure they're all watching online. So, hello and good evening to all of them as well. Uh, thanks for coming out and delegating here today. I know you've delegated previously as well when it was the public portion of the meeting. Uh, and it's very uh it's encouraging to see the amount of participation from uh residents not only just locally in your neighborhoods, on the streets, in your homes. I've seen a lot of that happen over the last two years. Uh a lot of people usually just you stopped that the within the first 6 months. Uh you've come here and delegated uh in front of council multiple times about this. Um you did some great use of uh AI in uh creating all the slides, putting everything together looks neat. Uh hope your kids are getting amazing grades in their presentations at school as well. Um but uh seeing the amount of work that you guys have put uh forward uh just want to say that this is for the rest of the audience as well and I know there's members for other applications here. um you know you're a great uh display of what public advocacy and participation in this process looks like. I know a lot of times people lose their hope on process and said none of this matters but that's why we're here. So thank you for that. Thank you to um all the staff as well that have worked on this report uh taken all public feedback into consideration all the correspondents the 700 plus signatures that we're seeing here um that have gone through every argument uh and you guys have the professional backgrounds to do so uh to providing that report that is in front of us that is uh as of now uh according to staff they are uh refusing uh the application um and a lot of work has gone towards this so thank you to uh our planning teams and planning staff as Thank you councelor Tur deputy mayor Singh >> thank you and I want to echo the comments of my uh colleague regional counselor gpatab singur um this is uh rare uh but this is a testament to the public engagement and consultation that occurred on this and I know I know the group we don't always get the results uh but this time when it matters we got the results and a big shout out to staff for listening and going through all the policies and read reading all the delegations um and correspondence and making a decision that aligns with our position as well. Uh so we we will be supporting uh the refusal and thank you to staff for listening and thank you for the community for engaging. Thank you so much. Thank you very much um to the area counselors and staff. So that uh the uh items on the board item listed uh one and two. Number three that the amendments to the official plan generally shown in attachment 12 be refused. Um and that the amendments in the zoning bylaw generally shown in attachment 13 also be refused and that there's no further public meeting no further notice of public meeting be required for the attached official plan that the following delegations to the planning committee also be received that correspondence be received and I think that's all been moved by council tour all in favor That carries. Congratulations to the res. >> Our next item is item 7.3 that was held by councelor Tour 6889 Mayfield Road. Application to amend the official plan and zoning bylaw, but we'll move it over to councelor uh deputy mayor Singh. >> So, >> uh, sorry, Deputy Mayor Singh. Today it seems like we hit a double whammy and uh we're getting results again. So I want to thank the community from Erik Drive. Um I know it was a long process and um you listened though. Uh you engaged with staff once again. Staff heard your concerns. Uh we had we visited numerous times as well and we really tried to understand what was going on and and try to understand what the community sentiments were. Thank you to staff for reviewing uh all the correspondents, listening to all the residents and and making an informed decision. Once again, uh that we uh myself and and councelor Ter are aligned with. Um we will continue to listen to you and um thank once again really thank you to staff. Uh we will be supporting uh this decision by staff. Thank you so much. >> Councelor T. Uh just a very quick word on this, not to repeat the same things, but uh a sincere thank you to staff. I know these two files back toback have not been uh the easiest to deal with. And given the amount of public engagement, uh I still remember being at the park and and meeting uh all the residents there, hearing everybody's concerns, and you guys have come out repeatedly as well.
