Good evening everybody. I'd like to call this meeting to order for March 17, 2026 for the committee of adjustment. Uh the committee members in attendance this evening are Kevin Antonitis at my side. Uh FA Billing is online, Adam M's head is online, Dylan Bailey is online, and myself, Daniel Collins. Staff members present this evening are Kristen McCauley, the director of planning and development, Manny Singh, a planner who is online, and Delhara Abby Ward, the secretary treasurer to my side. We're going to go through some committee business uh to begin and then we'll get into the applications. Uh first off, uh this meeting will be live uh livereamed. Members of the public are advised that our meetings are livereamed by the town of Grimby. Individuals and media may be audibly and or visually recorded during this meeting. As a reminder, all electronic devices are to be in silent mode during our committee meeting. for an overview of the meeting procedures. The purpose of the application and relative correspondence will be heard following which the applicant will be given the opportunity to address the application. Any person concerned with the application will then be given an opportunity to speak. At the conclusion of the of the discussion, the committee will render a decision and advise of any applicable conditions. Copies of decisions will be mailed to the applicant or agent and to any other person who uh files a written request. To request a copy of the decision, please email Abby uh uh sorry uh email Delhara Abby Warden, the secretary treasurer at coa grimby.ca. The applicant, the town of Grimby, the minister or a specified person or public body has the right to appeal the decision itself or the conditions of consent to the Ontario Land Tribunal, the OOLT, within 20 days of the date of giving notice under subsection 17 for a consent application and within 20 days of the date of decision for a minor variance application. Specified persons and certain public bodies include public utilities, but do not include an individual or community association. Everyone present will be given an opportunity to comment on the applications being heard. Please address your comments and questions through me, the chair. Each participant will be provided five minutes to speak. Each participant may speak only once. If you hear your comment presented by someone else, please do not duplicate the remarks. When you are called, we ask that you state your name and address for the record. Agencies commenting on applications may request that certain conditions be imposed. Voicing objections to these conditions will not adversely affect the committee's decision. All members of the committee have viewed the properties on the agenda tonight and are familiar with the lands that the subjects that are subject to the applications. Do we have uh do any members of the committee have a pecunerary interest with respect to the applications that are before us this evening? Okay, I see none. We will now consider the adoption of the agenda. Would someone please make a motion to adop adop adopt the agenda as presented? I see Dylan uh motions and Adam uh seconds. Have the committee members had the opportunity to review the minutes from February 17th, 2026? Are there any questions or comments about the minutes? Okay, I see none. Do we have a mover and a seconder to approve the minutes? Okay, Adam, I see you uh move and and uh Fay, you're going to second that. Thank you. Now, put it to a vote. All in favor, raise your hand. I see no one opposed. That is carried. Tonight we have one application before us. The application uh is A0226 for 24 Teter Place. And I'll call on the uh secretary treasurer to read the application or present the application for the committee. Thank you, Mr. Chair. Just get the presentation on full screen. So the purpose of this application is to permit um or rather sorry the variances requested um are to permit an encroachment of a porch covered deck inclusive of its related eaves and gutters of 2.65 65 m into a required rear yard. Whereas an encroachment of 1 and 1/2 m is permitted for a porch and to permit a minimum interior sideyard of.9 m at the southerntherly lot line whereas a minimum interior sideyard of 1.8 m is required. This is an image of um the site plan which was circulated along with the notice of hearing. This is an image of the neighborhood for context. These are the current conditions on site and these are some sorry there's a lag. These are some images of uh what is proposed for the site. These are the agencies that have provided comments and I will summarize those comments for you now. Planning staff have no objections to the minor variance proposed by the applicant. They have reviewed the application under section 45 of the planning act and are of the opinion that the minor variances meet the intent of the official plan and the zoning by law are appropriate for the development of the lands and are minor in nature. Heritage planning staff commented to say there are no heritage or archaeological concerns. Development engineering staff have no conditions and a couple of comments. Their comments are there shall be no encroachments andor infrastructure within the 1 and 1/2 m ement along the north property line that is footings, eaves, trough, window wells etc. and a lot grading and drainage plan may be required at time of building permit stage. The NPCA commented to say no NPCA regulated features currently exist at this address. The NPCA offers no objections to development as a result and the Niagara region have no comments. Back to you, Mr. Chair. Thank you. Is the applicant or agent here? And uh would they uh be able to speak to the reasons why they would like to have the variance? Uh yes. Thank you. That would be my Yeah. Thank you. If you could just uh state your name and address for our records and then go ahead. Isabella Bert from DRT Custom Homes. Uh the address is 24 Teter Place. And the reason why we need um the encroachment for the back porch, it's just the lot size is very irregular. So to put a house on it um makes it a little bit challenging. So we had to um extend the one side on the left or on the right side opposite of the easement just to make it a little bit bigger for the client. Okay, thank you. Uh, do we have any questions from the chair or not from the chair, from the committee? Sorry, I don't have any questions. No. Is there anyone in the public that wishes to speak to this application? I see none. Uh, does someone on the committee have a a motion? Yeah, Kevin, go ahead. Thank you. All right, I'll make a motion that resolve that minor variance application A0226 for 24 teter place to permit an encroachment of a porch covered deck inclusive of its related eaves and gutters of 2.65 65 m in a required rear yard. Whereas an encroachment of 1.5 m is permitted for a porch as per section 49C of the zoning bylaw as amended and to permit a minimum interior sideyard of 0.9 m at the southerntherly lot line whereas a minimum interior sideyard of 1.8 m is required as per section 721 table 11 of the zoning by amended be approved. Okay. Thank you. Uh, is there someone that would like to second this motion? Adam. Thank you. Okay, we will vote on this. All in favor, raise your hand or say I. And I see uh none in opposition. So that uh this is carried. Um and uh I would just like to note that there is a 20-day appeal period before this minor variance uh decision becomes legal and binding. Thank you uh for being here. Thank you. Okay, that was the only application. So, we're going to move into some other business. Um, you're free to go or stay. It's up to you. Uh, um, except for the committee members, of course. Um, we would now like to consider the annual rotation of the chair and vice chair positions. Uh, would anyone like to nominate themselves or someone else for the position of the chair? I could, Mr. Chair, I will make a motion that uh yourself, Dan Collins, be appointed as chair of the committee for a period of one year until the new committee is elected if you're willing to stand. Yeah, thank you. I'm honored to do so to stay on. Um, do we have someone that can second that? FA. Thank you. And we'll put that to a vote. All in favor, raise your hand. And I'll raise my hand on this one, too. I see no one opposed. So, that is carried. Uh, secondly, uh, for the vice chair nominations, uh, mover and seconder. Um, I'll I'll move uh I'll reciprocate that uh Kevin vice chair. Uh I'll I'll move that Kevin be the vice chair for a year or um uh new committee. Thank you. Until the new committee is elected.
